Before paying for property in Morocco, check three files: the property and seller, the contract and safeguards, and the money trail. A home under construction also needs permit checks, construction-linked instalments and protection for advances. Buying from Europe or the UAE adds foreign-currency records and future resale planning.
Document review: 11 October 2026. This guide mainly covers an individual buying privately owned residential property in Morocco. Companies, inheritance, gifts and land with special legal status require separate analysis. The applicable texts and transaction file take precedence over examples.
What changed in 2026, and what is still a proposal
Finance Law 50-25 for 2026 provides an additional 2% registration duty for certain property acquisitions above MAD300,000. It covers, among other cases, deeds missing payment methods and references, or payment outside CGI Article 11-II methods. It applies to deeds and agreements drawn up from 1 July 2026. Section 4 explains the details and examples.
Finance Ministry — 2026 measure and effective date
IGOC 2026 also raised the regulatory ceiling for the relevant dirham property loans to non-resident foreigners and Moroccans abroad (MRE) to 80%. The balance must follow foreign-exchange rules. Permission to lend up to a ceiling is not bank approval. An older official page numbered “Article 793” still mentions a 30% contribution; use current Articles 202–203 and the FAQ linked in section 8.
On 11 October, the ministry’s 2027 draft-budget page presents preparatory documents. This guide does not treat proposed measures as enacted law. Off-plan sales are explained using Code of Obligations and Contracts Articles 618-1 to 618-20, notably amended by Law 107-12. Those safeguards were not created by the 2026 Finance Law.

Who can buy: Moroccan resident, MRE or foreign national?
A foreign individual can buy ordinary privately owned residential property within the urban perimeter in their own name; forming a company or having a Moroccan partner is not a general prerequisite. The National Council of the Order of Notaries confirms this possibility. Check the parcel’s legal status and the seller’s identity and authority. A European or Emirati passport does not replace these checks.
National Council of Notaries — foreign property buyers
Outside the urban perimeter, do not assume the same freedom. Foreign acquisition of agricultural or potentially agricultural land is regulated; a non-agricultural project may need an AVNA/VNA certificate. The 29 April 2022 interministerial circular ties it to a non-agricultural project and excludes, among other cases, high-potential agricultural zones. A land title or a “villa” advert does not settle eligibility. Consult the regional investment centre, urban agency and notary before committing.
Urban Agency — official AVNA circular
Nationality, foreign-exchange residence and tax residence are different facts. A Moroccan living in Dubai is an MRE, rather than automatically a foreign buyer. A French national established in Morocco has a different file from a non-resident French national. Tell the bank and notary your circumstances at the outset.
Buying a completed home: steps and documents
- Set the intended use and complete budget: living, rental or business use; price, acquisition costs, borrowing, repairs and recurring charges. Visit in person or appoint an independent person. Check damp, electricity, utilities, access, areas and occupancy.
- Have the drafting professional examine the file before a payment. For registered property, obtain a recent ownership certificate and land-title references: owners, mortgages, attachments, easements and registered rights. ANCFCC describes the certificate as the legal and physical position at the time requested; an old copy does not establish the signing-day position.
ANCFCC — what an ownership certificate establishes
- Gather relevant records: identity and civil status, marital property regime where relevant, title and plans, occupancy/conformity documents for the building, co-ownership records, occupancy status and representative’s powers. A company seller or co-owned property needs authorised-signatory checks. This is a preparation list; the notary determines the required documents.
- Have the preliminary agreement define the true price, description, inclusions, timing, financing conditions and what happens to an advance if a condition fails. Bank refusal alone does not guarantee repayment: have the condition and procedure written before signing.
- Approve the financial breakdown and bank instructions, sign the deed, then follow tax registration and land-register inscription. For titled property, keys and tax registration do not replace recording ownership in the land register. Obtain completion evidence and check the updated certificate.

Buying “cash”, without a mortgage or via CDG: the 2% duty
A cash purchase in the sense of “mortgage-free” can be paid by bank transfer. Paying in physical cash means banknotes. The notary’s client-funds account with Caisse de dépôt et de gestion (CDG) concerns custody of money; it does not automatically make a banknote payment compliant for tax purposes.
For a transaction within the measure’s scope from 1 July 2026, priced above MAD300,000, 2% may be added if the deed lacks payment methods/references or payment does not use CGI Article 11-II methods. These include a crossed non-endorsable cheque, bank transfer and electronic payment. For a documented mixed payment, the duty applies to the physical-cash part. The threshold refers to the property price, not just the banknote portion.
CGI 2026 — Articles 11-II, 133-III and application provisions
Example: MAD1,000,000 property, MAD900,000 by compliant transfer and MAD100,000 in physical cash, with correctly recorded methods/references: MAD2,000 additional duty on the cash portion. If the deed omits payment methods/references, the separate trigger can expose the full price, or MAD20,000 here. This is additional to ordinary registration and other costs. At exactly MAD300,000, this property measure’s “above” condition is not met.
Before depositing banknotes into a bank or CDG account, ask the notary for written tax classification of the proposed money trail. Keep the deposit receipt; do not treat it as automatic exemption. Declare the actual agreed price and all advances: off-deed payments undermine evidence and duty calculations.
How to organise payment through the notary and CDG
Law 32-09 Article 33 requires the notary to deposit money held for others with CDG on receipt. Decree 2.14.289 governs the account in the notary’s name. TGR describes deposit receipts and associated transaction checks. This custody system does not replace an off-plan guarantee, title checks or lawful-source documentation.
TGR — notary-account framework under Decree 2.14.289
- Request a named statement separating price, advances, tax, registry charges, fees and refundable sums. Verify the account holder, account details and file references through an established channel with the notary’s office.
- Confirm accepted payment methods and when cleared funds must arrive. For overseas payments, agree currency, conversion, charges and required evidence with both banks. Confirm exact cheque payee wording or copy the specified transfer reference.
- Obtain the receipt, bank evidence and confirmation that references are recorded in the deed. Ask what conditions release money to the seller or return it if the transaction fails. Verify any account-detail change received by message directly with the notary before acting.
Buying off-plan in Morocco: VEFA contracts and advances
VEFA is a sale of property to be built within an agreed period, paid progressively as work advances. It does not automatically follow French rules or Dubai practices. Neither the optional reservation contract nor the preliminary contract can precede the building permit. Article 618-8 treats payment before the preliminary contract, or reservation contract where used, as void.
The preliminary contract must follow the statutory form: an authentic deed or a date-certain deed drawn by an authorised professional. It identifies parties, title/property references and charges, permit, description and approximate area, price, payment, delivery and guarantee details. Obtain plans, specifications and the guarantee copy. A sales brochure or merely legalised signature does not establish compliance with all these requirements.
A reservation contract provides withdrawal within a maximum one-month period and full refund within a maximum seven days after exercising that right. Its non-renewable validity is no more than six months, leading to the preliminary contract or repayment. Reservation money goes into the seller’s special bank account, unavailable during the withdrawal period, with a receipt for the buyer. This is distinct from the notary’s CDG account.
Code of Obligations and Contracts — VEFA Articles 618-1 to 618-9 (WIPO Lex)
Statutory instalments: how much at each stage?
Article 618-6 sets maximum payments based on the full price: 5% at reservation; 5% at the preliminary contract, or 10% without reservation; 10% at start of work; 60% allocated across three agreed phases, payable on completion of ground-floor foundations, the whole building’s structural work, then finishing with occupancy/conformity permission; 20% at the definitive sale and key handover. The 60% does not automatically mean three equal 20% instalments: check the agreed allocation and proof of each completed stage.
For a MAD1,000,000 price with reservation: MAD50,000 + MAD50,000 + MAD100,000, then MAD600,000 across the three contracted stages, and MAD200,000 at the final stage. Without reservation, the first two fractions become MAD100,000 at the preliminary contract. These amounts concern the price only; request separate costs.

Guarantees, delays and handover: questions to ask
After the preliminary contract, the seller must provide a completion or instalment-refund guarantee, subject to statutory Article 618-11 exceptions. The drafting professional cannot release instalments held to the seller before a guarantee covering all paid instalments is obtained. Ask about issuer, coverage, duration and claim procedure; “money held at CDG” is not a copy of that guarantee.
For registered property with advances exceeding 50%, Article 618-10 allows a protective pre-registration based on the preliminary contract. For delay, do not stop payment without analysis: the Code provides conditional extensions, formal notice and compensation, as well as remedies. Have a professional assess those conditions for your file; compensation is not an automatic bank transfer.
A finished-looking building alone is not legally complete: occupancy/conformity permission, the architect’s certification and separate titles for registered property matter at completion. Record specification differences, defects and missing documents at handover and agree their treatment in writing. For registered property, ownership transfers through inscription of the definitive deed or judgment in the land register.

Buying from Europe, the UAE or Dubai: the money trail
Agree the route with an authorised Moroccan bank before transferring. Foreign investments properly funded in foreign currency benefit from convertibility for income and disposal proceeds. A resale transfer file includes purchase/sale deeds, compliant funding evidence and tax records. A convertible-dirham account may be part of the bank-approved route; it is different from a convertible term account used in other situations.
Office des Changes — settlement and evidence, Articles 174 and 177
Keep a readable chain: source account, transfer order, credit/conversion advice, property payment, receipt and deed references. If a spouse, company or third party funds the purchase, confirm classification and evidence in advance; avoid using a relative’s account merely for speed. Article 174 provides a specific case for offshore payment between eligible sellers/buyers; it does not permit paying every Moroccan property sale abroad. Validate the arrangement before paying.
Europe and the UAE do not create a separate Moroccan purchase regime simply by location. Relevant variables include nationality/residence, funding source and property status. Compare net MAD received, including outgoing/intermediary fees, conversion and timing. This guide assumes no fixed EUR/MAD, GBP/MAD, CHF/MAD or AED/MAD rate.
When carrying foreign banknotes, declaration on entry to Morocco is mandatory from the equivalent of MAD100,000. Even below that threshold, the official FAQ requires the declaration to substantiate currency when funding a foreign-currency/convertible-dirham account. Check departure-country requirements separately. A customs declaration alone does not settle the tax classification of a property payment.

Loans for MRE and foreigners: ceiling, contribution and costs
Current Articles 202–203 permit up to 80% of the acquisition/construction price for the relevant property loan. The balance and repayments follow foreign-exchange Article 11. Article 203 requires a non-resident foreign individual financing a residence to provide a declaration of not owning a residence in Morocco; MRE are exempt from that declaration. The bank still assesses affordability, security and insurance.
Office des Changes — current Articles 202–203
For MAD1,000,000 property, a loan at the ceiling would be MAD800,000 with MAD200,000 left towards the price. Add acquisition and financing costs; they are not included in that balance. Request a written offer stating interest before/after VAT, insurance, term, security, instalment and total cost. Coordinate release with VEFA stages where applicable.

What should you budget beyond the price?
For an ordinary built-property purchase, CGI generally provides 4% registration duty; bare land generally 5%, subject to classification and special regimes. ANCFCC’s published ordinary-transfer brochure lists 1.5% plus MAD100, with minimum collection of MAD500. Add confirmed professional fees and their VAT, disbursements/documents, agreed agency fees, finance costs and any applicable 2% duty. A tax-inclusive property price and VAT on professional fees are different items; do not mechanically add 20% to an advertised tax-inclusive price.
ANCFCC — published fee brochure; confirm your specific formalities
Example for built property at MAD1,000,000: MAD40,000 registration + MAD15,100 transfer = MAD55,100 for those two items only. This is not the full acquisition-fee bill. Request an itemised breakdown and distinguish final costs from advances to reconcile. Special fees, multiple titles or exemptions can change the result.
Calculate acquisition costs using confirmed figures
After buying, budget co-ownership charges, insurance, maintenance and taxes relating to occupation, rent or resale. If tax-resident in Europe or elsewhere, check your country’s reporting obligations and applicable tax treaty. Living in Dubai does not establish that Moroccan property income is free of tax.
Buying remotely: power of attorney and preparation file
Have the Moroccan drafting professional prepare the power of attorney before it is signed abroad. Specify property, price or limit, signing/formality powers and any intended authority over funds. Ask which form, translations and apostille/legalisation are required for the issuing country. Do not assume a scanned signature or online template is enough.
Preparation file: valid identity; address/residence evidence; relevant civil status and marital regime; funding-source evidence; transfer records; draft contract and financial breakdown; property records; approved power of attorney if represented. A loan adds income, debt, expenses and bank-requested documents. Do not send sensitive evidence to an unverified intermediary.
Frequently asked questions before signing
Does buying an apartment give you residence status?
A property deed is not a residence permit. Check entry and residence requirements separately with the competent authorities; do not base a purchase on an undocumented residence promise.
Can you buy without being in Morocco?
Representation can be arranged through an acceptable power of attorney. Confirm wording and formalities before travel, signing or transfer. Keep independent property checks even if a relative signs.
Can I pay the developer directly or reserve without a permit?
Check contract, lawful stage, designated account and safeguards before paying. VEFA reservation before a building permit is prohibited. Do not pay a “holding fee” to bypass those stages; a payment’s marketing name does not determine validity.
Can every foreign buyer acquire land with a house?
Not without status checks. A house does not automatically remove agricultural classification or special land status. Verify urban perimeter, legal status and any AVNA requirement before an advance.
How can you transfer future resale money abroad?
Build the foreign-currency funding file when buying. The bank checks deeds, evidence and tax. For Moroccan credit, rules account for the foreign-currency contribution, principal repaid through the stipulated methods and any gain; do not presume the whole gross sale price is immediately transferable.
Can Daam Sakane be used for a home still being built?
Check official applicant and property requirements, including Moroccan nationality, first sale and occupancy permit issued from 1 January 2023. An off-plan reservation alone does not establish property eligibility or programme approval. Aid is not a general incentive for foreign buyers.

How long does buying a completed home take?
This guide gives no guaranteed completion time. Credit, representation, foreign records, mortgage release, land status and transfer can change timing. Ask for steps, responsible parties, evidence and estimated dates rather than a “seven-day” promise.
Your checklist before any payment
- Does the seller own the property or hold valid authority? Have title and charges been checked recently?
- Can you legally acquire this property in your circumstances, especially outside the urban perimeter?
- Do permits, contract and co-ownership documents match the property inspected?
- For VEFA: are permit, lawful instalments, verifiable guarantee, timing and handover conditions documented?
- Are true price, costs, advance and refund conditions written down?
- Are account, payee, funding source and deed references validated?
- Do financing and payment dates align? Will evidence needed on resale be retained?
- Who follows tax registration, land inscription and delivery of an updated certificate?
